Brief considerations on certain vulnerable groups

Summary/Abstract: The aim of this study is to analyse the different situations in which a victim of a crime can be considered a vulnerable person. Another purpose of this study is to propose a theory regarding a type of secondary vulnerable victim in certain situations, which have been described thoroughly by the European Court of Human Rights in its decisions regarding torture, inhuman or degrading treatment. Thirdly, the present article analyses the situation of transgender persons and of those suffering from AIDS. Finally, this study refers to the legal situation of immigrants and to the possibility of regarding them as vulnerable victims in criminal law.
