Brief considerations with regard to the meaning of pornographic materials and pornographic performances. Similarities and differences

Summary/Abstract: The aim of this paper is to analyse the offence of child pornography, as it is regulated by art. 374 paragraph 1 and paragraph 1^1 of the Romanian Criminal Code, by reference to pornographic materials depicting children and pornographic performances with children. The author analyses the meaning of each of these two elements of the offence and then highlights some regulatory differences between the two criminal provisions mentioned above. Likewise, the author argues that art. 374 paragraph 1 and paragraph 1^1 of the Romanian Criminal Code can result in a concurrence of offences.
