Commentary on the resolution of the Supreme Court of 3 October 2023, III CZP 22/23

Summary/Abstract: In the resolution under review the Supreme Court accepted that legal entities are entitled to claim for compensation of immaterial harm related to violation of their personal rights. The author agrees with the judgment of the Supreme Court and proposes additional arguments to justify it. The commentary discusses the criteria that should be taken into consideration when determining the scope of immate- rial harm suffered by a legal entity, as well as the functions of damages for moral harm.
