51. Non-pecuniary damage for the damage suffered after the sanctioning decision was issued

Summary/Abstract: The claimant requested non pecuniary damage for the non pecuniary damage suffered as a result of the sanctioning decision. The court analyzed this damage only from the perspective of issuing the sanctioning decision and not in the light of the factual situation existing at the workplace prior to this decision. However, by the grounds of appeal, the claimant invoked other aspects than those invoked at first instance, new reasons that could not be analyzed considering the provisions of Article 478 Code of Civil Procedure.
