47. Application in time of the provisions of Law no. 153/2017 on the remuneration of staff paid from public funds. The effective date of the increase governed by art. 19 of Appendix VI to Law no. 153/2017

Summary/Abstract: The contested issue in this case is represented by the establishment of the date on which the provisions of art. 19 of Appendix VI to Law no. 153/2017 become effective, precisely of the fact whether the respective provision became or not effective on 1 July 2017. The hereinabove note is indicated in Appendix no. VI to Law no. 153/2017 governing the remuneration within the family holding budgetary positions “defence, public order and national security". As regards the application of the provisions of Law no. 153/2017, there are express provisions laid down in art. 38 of this law. According to para. (1) of art. 38, the provisions of this law “shall apply in stages, starting from 1 July 2017”, and the following paragraphs indicate the rules which shall apply starting from 1 July 2017 and from 1 January 2018, 1 March 2018, during the period 2019 2021 or during another period. Given that the content of Law no. 153/2017 contains a legal text which expressly governs the method of timely application of this law, namely the provisions laid down in art. 38, in this issue related to the application of law, the respective provisions are special in relation to the provisions laid down in the appendices to the respective law.
