Summary/Abstract: One of the conditions for the efficiency and legality of the activity of public authorities is the correct application of legal norms in their activity. Otherwise, according to art. 53 of the Constitution of the Republic of Moldova, the person injured in his right by a public authority, through an administrative act or by not resolving a claim within the legal term, is entitled to obtain the recognition of the claimed right, the annulment of the act and the reparation of the damage. Therefore, any control carried out over the activity of public authorities should be well stipulated by legal norms in order not to affect the rights of natural or legal persons.
