Summary/Abstract: The glosa analyzes the judgment of the Constitutional Court (CC), which ruledunconstitutional the provisions allowing the President of the National Bank of Polandto be held accountable before the State Tribunal. The main objections to the CC’s ver-dict were considered to be the partisanship of the ruling, as the influence of politicalfactors is clear, rather than solely legal arguments. Violation of the principle of lega-lity, since the CC went beyond the scope of the complaint, over-interpreted the will ofthe Applicants and attributed to itself a law-making role in the matter of fact. Thus,it undermined the principle of the tripartite division of power. As a result of the CC’sjudgment, the control over persons holding high public functions has been limited,making it possible for them to abuse their power.However, the assessment of the analyzed judgment of the Constitutional Court isnot unequivocal, as the author admits the correctness of the Constitutional Court’sassessment of Article 11 of the Law on the State Tribunal, hence the conclusion ofthe glosa is only partially critical.
