PROBLEMS, CONCERNING ONUS PROBANDI AND THE ROLE OF THE IUDEX IN THE FORMULARY PROCEDURE

Summary/Abstract: The problem of burden of proof in Roman litigation, and more specifically –in the formulary process, is the subject of numerous disputes among researches. The mainquestions that arise are related to both lack of strictly established rules regarding thedistribution of onus probandi, and circumstances, concerning the extent of discretion, grantedto the iudex in the phase apud iudicem. The present article examines the Roman judicial processin precisely this aspect, outlining some of the main points on the subject and offering a furtherinterpretation of the problems, mentioned above.
