Summary/Abstract: Throughout this material we intend to address a topic that we consider to be particularly important and still of interest, namely children’s rights and their status as autonomous subject of rights, so that they are respected and exercised accordingly. The paper will be structured into four parts. In the first part will be presented some general aspects justifying the chosen subject. In the second part we will speak about the principle of the evolving capacity of the minor, its concept and content, based on the provisions of the United Nations Convention on the Rights of the Child and how it relates to the principle of the best interest of the child and the rights of the child to be heard, to express their opinion and to be taken into account in the decision making processes. The third part will underline the manner in which the aforementioned principles and rights have been included in the general provisions of the Civil Code on parental authority, and the last part will be reserved for conclusions.
