HIGHLIGTHS IN THE STUDY OF THE LEGAL REGIME OF TREES AND SHRUBS OUTSIDE FORESTS

Summary/Abstract: In the broader context of the necessity to increase the quantity and quality of green spaces, both inside and outside urban agglomerations, as an indispensable element in the management of climate change and ecosystem services, as well as for increasing resistance to pests and biotic diseases, in the conditions in which the issue of the protection of trees and shrubs is the subject of several specialized normative acts, the author analyzes their legal regime from the perspective of other (non-specialized) normative acts, concluding that a wide-ranging labor for completing, concentrating and systematizing the legislation it is necessary, indicating the directions in which this effort should be directed. A particular attention is paid to the need to penalize non-compliance with the obligation to carry out maintenance measures for green spaces with trees and shrubs by their owners and administrators and the obligation to drain excess water from the surface of green spaces into the rain water collecting network, in connection with which de lege ferenda proposals are advanced.
