Summary/Abstract: A new method of regulating the relations between the state and religious organizations provided for in Article 25(5) of the 1997 Constitution has a number of advantages but is not free from flaws. No doubt, the adopted bilateral approach enables both parties – churches and the state – to determine mutual rights and obligations in the spirit of partnership. It further allows for the specific attributes of a given religious organization in terms of its relation to the public authorities (and vice versa). The departure from the unilateral concept of regulating the status of religious organizations by the state also affirms the recognition of their non-religious role as components of the civil society, e.g. as community, charitable, cultural or educational organizations. Notwithstanding the foregoing, the constitutional novelty of Article 25(5) of the Constitution must also be seen against the backdrop of the principle of equality between churches and other religious organizations, set out in Article 25(1) of the Constitution. The article attempts to envisage the difficulties that a departure from bilateralism might entail, especially when coupled with the return to the concept of a single legal act governing all denominations. The author also highlights the threats that may arise from the abuse of Article 25(5) by religious organizations entitled to undertake such a regulation.
