Summary/Abstract: The subject of this article are public law instruments for controlling the performance of duties by a doctoral student studying at a doctoral school. The study presents the complex status of a doctoral student, which consists of both public law and civil law obligations (resulting from an individual research plan) and outlines a model of due diligence in science (also binding for a doctoral student). It turns out that in the first period of doctoral studies, direct participation in classes has a significant impact on the scientific development of a doctoral student. Unfortunately, in practice, it shall be noted that the legal instruments that the doctoral school has to control this obligation are ineffective, because there is no sufficient tools to verify the authenticity of acknowledgment on health conditions. The last part presents public law sanctions with an indication of what changes should be introduced in the applicable regulations in order to prevent from an misuse in receiving scholarships by people who only pretend to do scientific work. These changes will not cause additional costs in public finances, but will only seal up the system.
