Summary/Abstract: The paper presents the transcription and translation of the Patent on the ban on emigration and recruitment in favour of a foreign military or civil service, adopted by Empress Maria Theresia on 21 July 1752 for the province of the Banat of Temeswar. The introductory text sheds lights on the circumstances surrounding the adoption of this document, and presents short contents of its 17 provisions. The Patent was issued in a bid to halt increasingly frequent emigration to Russia, triggered by the demilitarisation of the Potisje and Pomorišje military border. We bring this document not only with the aim to elucidate that historical episode, but also as a contribution to the study of the penal legislation of the Habsburg Monarchy in relation to the phenomena interpreted as first-order threats to public order and security across its periphery.
