Summary/Abstract: Adoption of the Preliminary Ruling (HP) of the Chamber of the Court of First Instance of the European Communities for the resolution of questions of law in criminal matters No 64 of 2 October 2023 on the procedure provided for in Article 148(2) of the Criminal Procedure Code. 3 of the Code of Criminal Procedure has led to a change in case law in the work of the judiciary, with direct consequences both on cases still pending and on the future approach to the application of the legal provisions mentioned. This article aims to clarify the controversial issues that have arisen in the practice of the judiciary and to establish the legal effects of this change in the interpretation and application of the legal provisions.
