General Considerations on the Crime of Unjust Repression

Summary/Abstract: Judges and prosecutors, throughout their entire activity, have the obligation to ensure the supremacy of the law, to respect the rights and liberties of people as well as their equality before the law, and to ensure a fair judicial treatment to all participants in the judicial proceedings, regardless of their status, to abide by the Deontological Code or the judges and the prosecutors. The magistrate shall not be held responsible penally or disciplinarily when the ruled procedural measure or the ruled solution resulted from the analysis of the whole evidence material administered in the case.
