Summary/Abstract: The aim of this article is to compare certain segments of the Shariah law and the positive legal system of Serbia and to present the similarities and differences thereof. The comparison presented here is based on the general characteristics of the two legislatures without a deeper analysis of the financial systems of the two legal frameworks and the barriers to the institutionalization of Islamic banking in Serbia. In other words, this article represents an initiating platform in the process of analyzing the common principles and meeting points of Sharia law and the positive legal system of Serbia. The similarities between these two legislative systems represent a contribution to further research work on characteristics of the financial systems of Sharia law and the positive law of Serbia and the potential for implementation of Islamic banking in Serbia.
