The Development of the Institute of Diplomatic Protection in International Law

Summary/Abstract: The author deals with diplomatic protection in international law and its development through history of the international community. in this sense, he studies the practice of States regarding the application of diplomatic protection and the steps being taken by the United nations international law Commission on the codification of this area. The author presents some basic conditions for launching diplomatic protection briefly analyzing their contents – the exhaustion of internal remedies and determination of citizenship. in the end, the article presents some basic guidelines for the development of diplomatic protection and its relationship with other branches of law which have an international element.
