The act on Consumer Rights of 30 May 2014: its origins, importance and scope of application in the insurance services sector

Summary/Abstract: The paper presents the new Act on Consumer Rights of 30 May 2014 that implements Directive of the ...uropean Parliament and of the Council 2011/83/...U of 21 October 2011 on consumer rights. The author analyses an impact that the new regulation may have on the insurance services market. She indicates the need to take into account the method of full harmonisation in interpreting the provisions of the Act. The main body of the paper discusses the substantive and subjective scope of the Act and its applica- tion to insurance contracts. It presents modifications of the general principles of consumer protection in the case of insurance contracts concluded in non-typical circumstances.
