Summary/Abstract: The main purpose of this article is to compare the legal position of investors in open investment funds and participants in “unit-linked life insurance”. This comparison (made also from a historical perspec- tive) includes pre-trade protection (prevention of misselling), disclosure obligations, protection models in general. The article also points out fundamental differences in protection models that are applied to investment funds and unit-linked life insurance. Last but not least, the article discusses the expected development of protection of participants in unit-linked life insurance schemes.
