The issue of the protection of the insured’s interests in a contract with an insurance capital fund

Summary/Abstract: The subject of the article is the protection of the insured’s interests in a contract with an insurance capital fund. The article defines the basic methods and goals of investor and insured protection as well as the material scope of this protection. The article indicates that the scope of protection is achieved through the right to information, protection against excessive charges and misseling. The thesis of the article is also that investor protection by extending disclosure obligations should be treated with caution – that is, taking into account the rational level of investor perception.
