Medical Capacity of an Employee and Medical Reports in the Civil Service

Summary/Abstract: The article deals with the concept of the assessment of an employee’s medical capacity for work performance. The first part of the article analyses health protection in legislation in a general and medical capacity as the work performance assumption, while the next part of the article focuses on the consequences of losing the employee’s medical capacity in employment relations including civil service relations. Particular attention is paid to the current issues regarding medical reports and relevant court decisions.
