Summary/Abstract: This article aims to investigate if the European security context and, particularly the evolutions of the Russian war of attrition on Ukraine are external factors of change with an impact on the way in which the Court of Justice of the European Union adopts foreign and security – related decisions, which are constitutionally silent matters. The study case of the ruling in the Case Russia Today France v. Council demonstrates that the Court of Justice of the European Union is strongly influenced by the foreign, security and defense policies of the European Union (EU), as well as by the actions and measures undertaken by the Union in the context of the Russian illegal invasion, proving that the war going on in Ukraine impacts highly on the entire European construct. Taking into consideration this landmark ruling empowering the role of the Court, the European debate makes an extremely important step in advancing constitutionalization at the EU level, including in the foreign, security and defense dossiers.
