Local referendum to dissolve the local council. Theoretical and practical aspects

Summary/Abstract: A referendum is a tool of the semi-direct democracy, through which the citizens express their will about issues of national or local interest. The use of this procedure by the citizens living in an administrative division can lead to the dissolution of the local council. By approving a referendum, the local community gives a vote of no confidence to the local councilors. Unfortunately, the Romanian legislation in relation to the above issues is incomplete, therefore it is difficult to implement it. In our study, we are presenting various theoretical and practical issues concerning referenda, and we are putting forward for consideration a number of proposals to amend the provisions of the Administrative Code with regard to the dissolution of a local council by means of a referendum.
