Summary/Abstract: The paper analyzes the criminal policy of the legislator and the criminal policy of the courts in the field of gender-based violence. In this regard, it is emphasized that the Criminal Code of the Republic of Srpska contains a certain number of incriminations that incriminate certain forms of gender-based violence, but that it is necessary to harmonize it with the Convention on preventing and combating violence against women and domestic violence. When it comes to the penal policy of the courts, it is pointed out that it is inconsistent with the penal policy of the legislator because it does not follow the legal solutions in that area, which seek to provide conditions for adequate protection of victims of gender-based violence.
