CURRENT PROBLEMS OF THE LEGAL PROTECTION OF INTELLECTUAL PROPERTY. PART I. ON THE PRELIMINARY CHARACTER OF THE PROCEEDINGS FOR THE CANCELLATION OF THE REGISTRATION OF AN INDUSTRIAL DESIGN IN CLAIMS FOR INFRINGEMENT

Summary/Abstract: In 2022, two interpretive court cases started in Bulgaria on intellectual property protection issues. Although IP cases do not account for a significant share of the overall workload of the courts, there has been an increase in IPR litigation, which is sufficient to set up conflicting court practices. In this and the next article, we propose answers to the questions referred to in the two interpretative cases. The first question concerns the preliminary character of the proceedings for cancellation of the registration of an industrial design in cases of infringement of the same design, and the second concerns the determination of the number of administrative infringements in cases of public performance of a recording infringing copyrights of a work of music under the Act on Copyright and Related Rights. The two articles have been prepared based on the sent opinions on the respective interpretive cases.
