Summary/Abstract: In this paper, the author analyses the right and duty of determining the cause of death of a patient in the procedure of autopsy. The law regulates circumstances in which autopsy is obligatory, and who has the right and duty to request autopsy to be performed in order for the cause of death of a patient to be determined. Members of the family of a late patient have the right to find out the cause of death of a dead person and request autopsy to be performed. Members of the family of a late patient have the right to find out the cause of death of a dead person even if the health institution fails to perform the obligatory autopsy and inform the relatives about the results of the autopsy. The health institution that fails to perform the obligatory autopsy and determine the cause of death of a patient who died in hospital is responsible for the damage caused by illegal and irregular work, no matter whether there is a doctor’s mistake or not.
