Organization, management and control of the activity of prosecutors, at the Prosecutor's Office attached to the Court of Appeal Târgu Mureș, during 2017-2022

Summary/Abstract: The present study aims to investigate the way in which the organization, the management and the control of the court prosecutor’s activity were put into practice, at the Prosecutor's Office attached to the Court of Appeal Târgu Mureș, in the period 2017-2022. The organization of the court prosecutor’s activity is materialized in the establishment of their activity, especially by their distribution in the court hearings. The court prosecutor’s activity must be organized in such a way that two features are met: stability and continuity. Management means guidance and control means checking. Management and control aim to meet two features: effectiveness and quality. By the effectiveness of the participation at the court hearings I understand the presence itself of the prosecutor in the courtroom. By the quality of participation at the court hearings I mean compliance with the legal provisions that provide the legal regime of the prosecutor's participation in the trial cases. Regarding the organizational, the equality of the number of prosecutors that make up the Judicial Section in relation to the number of appeal boards from the court was a positive element. In the reference period, however, there were intervals in which this equality was not maintained. The inequality of the number of prosecutors that made up the Judicial Section in relation to the number of appeal boards from the court, in these intervals, was a negative element, by not respecting the continuity. Starting with 2023, the negative element consisting of this inequality, which makes it impossible to respect continuity, has been reactivated. Regarding the management and the control, both a positive and a negative element are highlighted. The positive element consists in the fact that I attended, every six months, the sessions of analyzing the solutions from some of the lower prosecutor's offices. The negative element consists in the fact that I did not exercise the management and the control of the participation in the trial of cases by the prosecutors from the prosecutor's office attached to the court of appeal.
