Identification of illegal court decisions not challenged by the prosecutor and analysis of solutions for acquittal, restitution and referral, to the Prosecutor's Office attached to the Court of Appeal Târgu Mureș, during 2017-2022

Summary/Abstract: The present study aims to investigate the way in what identifying illegal court decisions against which the prosecutor has not filed remedies and analyzing acquittal, restitution to the prosecutor's office and referral to the prosecutor rulings were put into practice at the Prosecutor’s Office attached to the Târgu Mureș Court of Appeal, during 2017-2022. As for the illegal court decisions against which the prosecutor has not filed remedies, I have extracted the essence of several decisions, identified in the reference period. As for the acquittal, restitution to the prosecutor's office and referral to the prosecutor rulings, I have developed four analyzes: two of acquittals (one non-imputable and the other imputable) and two of restitutions (also one non-imputable and another imputable). Equally, within the second theme, I made a brief comparison between the period before 2017 and the period 2017-2022. These research methods allowed an evaluation of the Prosecutor's Office attached to the Târgu Mureș Court of Appeal activity, during the reference period. Following this evaluation, I highlighted the positive elements of identifying illegal court decisions against which the prosecutor did not filed remedies and analyzing the acquittal, restitution to the prosecutor's office and referral to the prosecutor rulings. The positive elements of those two types of activities outline the good practices that must be preserved in the future.
