Summary/Abstract: On the threshold of the political changes in Poland in the 1990s, the National Broadcasting Council was entrusted with performing public tasks in the field of broadcasting. A few years ago, the legislator decided to establishthe National Media Council, which was also given responsibility in the field of broadcasting. This study aims to examine whether, under the current legal status in Poland, the functioning of two public administration bodies in the field of broadcasting affects the performance of tasks by the constitutional body created earlier or whether such an effect does not occur. The main problem of the article is formulated in the question of “whether the creation of another public administration body in the field of broadcasting, namely the National Media Council, may give rise to problems in the performance of tasks by theNational Broadcasting Council?”. The analyses carried out in the study led to the conclusion that although the Polish law does not exclude the possibility of functioning of several public administration bodies in the field of broadcasting, the solution introduced in our country cannot be assessed as positive because the model adopted by the legislator of functioning of two broadcasting publicadministration bodies led to a situation in which the National Broadcasting Council is not able to perform its systemic function correctly, as determinedby the provisions of the Constitution. Maintaining this situation in the Polish legal order and social reality is contrary to the principles of a democratic state of law.
