Inheritance as a form of gender discrimination

Summary/Abstract: This paper is about the inheritance as a crucial need for the woman. Beside the basic right which by legal norms is procured and in which is understood the gender equality, we have to pay attention about the practice in the process of inheritance. In most of the cases we can see that the legal norms are not respected, actually it is put an emphasis on the tradition that imposes on a male inheritor. Because of the gender inequality in the inheritance process, often in terms of the life of the woman she faces up with a situation to struggle for her existence. These states of the woman are most often after a divorce, family violence, etc. Because of the fact that she doesn’t have an inheritance, she also faces difficult economic problems, which cannot be surpassed by every woman. And because of the fact that she often stays in an unproductive marriage, a marriage that includes a family violence and despite of her effort to leave that kind of a marriage, she again comes back to the bully and this is the reason why she is cut out of the process of inheritance.
