Summary/Abstract: The active role of the Territorial Administrative Units includes both their rights to benefit from property that belonged to deceased persons and an obligation to make every effort, within the mandatory time limits laid down by law, to take possession of the immovable property – land located in the countryside. Article 26 of Law 18/1992 provides for the special procedure whereby administrative territorial units acquire real estate located within the urban area of localities, which becomes their full property following the procedure laid down in this law. The active position of civil servants in administrative-territorial units must be demonstrated throughout the period of taking possession of the property. They initiate the procedure, carry it out and then, when they take full ownership of the property, take care of it like a good owner. Among the essential conditions for the transfer of vouchers to the ownership of administrative-territorial units is the condition that the land is a vacant inheritance. Otherwise, if the certificate of inheritance vacancy is issued in breach of the legal provisions, the persons concerned may bring an action before the court for annulment of the certificate of inheritance vacancy. For these reasons, in order to prevent disputes that may arise, the administrative territorial unit must show a continuous active role, to make all the necessary steps in order to acquire real estate land located in the intra-village within the legal limits.
