Summary/Abstract: Judicial practice has been faced and still is faced with the analysis of the caducity of expropriation decrees or expropriation decisions, respectively with the verification of the admissibility of such verifications, in the framework of some litigations having other objects than the establishing of caducity, which is why an investigation is also required regarding these aspects, based on a chronological perspective of the normative acts and the related incidental case law. Thus, in order to be admissible the examination of the validity of an expropriation decision or of an expropriation decree, incidentally, by the courts of law, it is necessary to establish precisely the normative act on the basis of which it has been issued.
