Summary/Abstract: This gloss is a comment to the Supreme Court Decision of 19 May 2020, IV KK 61/20. In this judgment, the Supreme Court rightly assumed that the interpretation of essential parts of the ammunition could not be extended. If the cartridge does not contain gunpowder as propellant, and there is no other material found in it that could justify its classification as ammunition or a substantial part thereof, no license was required for the manufacture and sale of such cartridges. The sale without a license of ammunition in the form of the 6 mm type Flobert K, i.e. the Flobert Short type rimfire ammunition for pistols and bang revolvers in the 6 mm caliber, does not ex-haust the features of the act under Art. 263 § 1 of Penal Code.
