The public administrator and the management contract of the public administrator in the context of the Administrative Code approved by Government Emergency Ordinance no. 57/2019

Summary/Abstract: The institution of the “public administrator”, regulated by the Administrative Code, largely resumes the provisions of the Law on local public administration no. 215/2001 (currently repealed), without clarifying, like the old normative act, essential aspects concerning the nature of this function and the manner of exercising it. In the spirit of the new normative framework established by the Administrative Code, the present study aims at a modest analysis of this institution, aiming to clarify the aspects regarding the legal nature of the public administrator function and that of the management contract based on which the public administrator operates.
