Summary/Abstract: The principle of judicial independence is a legal concept with multiple meanings, being, at the same time, an organizing rule for the judicial system and a fundamental human right. This is precisely why its effectiveness implies active participation from all public authorities as well as by the judiciary system itself. Thereby, the members of the other state powers, legislative and executive, must adapt their conduct in accordance to the requirements of judicial independence, as developed in the case law of domestic and international courts. The present article aims to analyze the principle of judicial independence and its implications on the relations between public authorities and the judicial authority, aiming to highlight the obligations meant to ensure the effectiveness of this essential rule and the mechanisms provided for guaranteeing the independence of the judiciary.
