The constitutional relationships between the Parliament and the Government of Romania

Summary/Abstract: The Romanian Constitution, as revised in 2003, states the principle of separation and balance of powers in a modern manner, by referring to the idea of constitutional democracy. The constitutional relations between public authorities acknowledge the mutual involvement of some in the sphere of activity of the others, involvement that signifies the achievement of a balance through collaboration and control. The evolution of modern democracies takes place around the relationships between the Government and the Parliament, and, for the proper functioning of the rule of law, the collaboration between state powers has a particular importance. The principle of separation and balance of powers implies a mutual control between them, in terms of performance in accordance with the law of their specific tasks, which is a specific mechanism for the rule of law and the democratic order, to avoid abuse by one or the other of the state powers.
