Theses and antitheses regarding the draft of the Administrative Code of Romania

Summary/Abstract: Starting from the recent adoption of the Administrative Code Theses, the paper proposes some reflections on the necessity of normative intervention in the field of general regulation of public administration and also in regard to the juridical instrument proposed for adoption: the scope, object, content, nature and basis of the act and last, its place in the formal sources of administrative law. It is a general opinion that according to the extent of normative intervention it is imposed to assure also substantive modifications, eventually a reform of regulations and principles that form the basis of some public administration institutions, in the context of the actual movement of state reform. The simplification of the normative system in the field of public administration would help to promote rule of law and to assure the stability of juridical relations/rapports.
