Group Proceedings as an Example of Non-code Judicial Civil Proceedings

Summary/Abstract: The article is devoted to selected issues concerning group proceedings as non-code civil proceedings.It discusses, inter alia, such issues as the essence and legal nature of group proceedings,the subjective and objective scope of the application of the Act on pursuing claims ingroup proceedings, the course of these proceedings and their initiation, the representative ofthe group and the judgment issued in these proceedings. The article analyses selected provisionsof the Act on the pursuit of claims in group proceedings, as well as the provisions of theCode of Civil Procedure that apply to group proceedings. The article also presents the doubtsthat arise from the application of the provisions of the law regulating group proceedings, andattempts to resolve them.
