Summary/Abstract: The criminal liability of artificial intelligence (AI) entities does not find its counterpart in positive Romanian law. A reluctance of the legislator that we understand, but do not encourage, in the context in which we are currently discussing real cases in which artificial entities are real agents who commit crimes. Thus, a careful monitoring of the legislator regarding the evolution of the society, namely the mass automation of society, is necessary in order to outline a well-defined and carefully shaped legislative framework to deal with the issue of criminal liability of AI. This article aims to illustrate an overview of the issue of criminal liability of AI, proposing models of liability, as well as defenses and sanctions adapted to the configuration of artificial agents.
