Summary/Abstract: The use of AI in the criminal justice system is becoming increasingly widespread nowadays, and the study on digital criminal justice suggests concrete actions to address current shortcomings in this area. In analyzing the impact of AI in criminal decision-making, greater attention must be paid to both the fundamental rights involved in the case before the court and the related procedural rights. Keeping in view that the human judge judges people, not cases, the presence of AI in the criminal proceedings should be exhaustively limited to providing support to human actors called to do justice, not to supplement their reasoning.
