Summary/Abstract: The article presents the idea and scope of mobbing and harassment in the sphere of work. It discusses the difficulties in differentiating these concepts on the basis of the labour code, which result from these terms being unclearly written into the regulatory provisions. Distinguishing these notions is essential given the different sanctions burdening employers. In the case of mobbing, the employee can claim damages resulting from having his or her employment terminated, as well as compensation for damage to his or her health. In the case of harassment, the employee is entitled only to compensation, but the termination of employment is not among the reasons for this.
