The influence of the exercise of the right to freedom of expression in judicial proceedings

Summary/Abstract: Ensuring a fair balance between the interests of justice and freedom of expression is to be achieved based on objective criteria, reasonably substantiated in terms of necessity. Starting from the importance of the functioning of all the mechanisms of the state, and implicitly of justice, we will analyze the way in which the freedom of expression can influence or not the act of justice. Thus, depending on the imminent necessity of limiting the freedom of expression that ceases once the examination of the case is completed.
