Summary/Abstract: In order to qualify the hours worked outside normal working hours as overtime work, it is essential that the employer has the initiative of demanding overtime work by the employee. Should the latter claim that such a request was made by the employer, the burden of proof lies with the employee, under Article 287 of the Labor Code.
