Summary/Abstract: The research objective of this study is an in-depth analysis of Article 2421 inserted in the Code of Civil Procedure, which introduces a new procedural action of the parties during the evidence procedure. Considering the fact that the regulation does not clearly specify if it should be treated as a new procedural obligation or merely a desideratum, it is necessary to determine how it will be executed in the procedure and what will be the consequences for the parties. The author analyses the regulation with respect to its personal and material scope, as well as a potential penalty imposed on a party to the procedure for failure to perform the instructions of the discussed regulation.
