Summary/Abstract: In the last three decades, there has been a clear crisis of reformist concepts in penitentiary systems – assuming the need for the social rehabilitation of people sentenced to imprisonment, in favor of the idea that the only obligation of the state is to protect righteous citizens from criminals and to control people who violate the law and pose a social risk. These ideas were included in the current called neopenology. The article presents the main thesis of neopenology, the sources from which this concept was developed, its advantages and disadvantages, as well as a critical analysis of the mentioned trend, and finally an attempt to present an alternative.
