Summary/Abstract: Although today, after almost 70 years of development, the primary law of the European Union seems to provide legal bases for all areas of Union competence, this has not been the case since the first stages of the Communities’ existence. Faced with the need to fill the gaps in an insufficiently developed Community primary law and the need to act in areas where the Treaties did not provide the necessary legal bases, the institutions of the Union have creatively combined the existing law with the political will to achieve results despite legal insufficiency, This has led to both quantitative and qualitative changes in the competences of what today is the European Union.
