Interaction Between Private International Law and Law on Personal Data Protection on the Example of a Contract for Entrusting the Processing of Personal Data

Summary/Abstract: The article presents how private international law and the law on the protection of personaldata interact with each other, in connection with the reference by the law on personal data protectionto private law institutions (concepts) for which the applicable law is determined by theconflict-of-law rules of private international law. The impact is shown on the example of a contractfor entrusting the processing of personal data, which is the basis for the lawful processingof personal data by the processor on behalf of the personal data controller. The main part of theconsiderations covers the analysis of the conflict of law rules of private international law usedto determine the law applicable to a contract for the processing of personal data, including thechoice of law and based on objective connecting factors.
