Transcription of the Birth Certificate of a Child of the Same-sex Couple

Summary/Abstract: Celem artykułu jest szerokie ujęcie problemu transkrypcji aktu urodzenia dziecka pary jednopłciowej. Pochylając się nad tym tematem, należy zauważyć, że nieodłącznym dla debaty w tej sprawie jest przede wszystkim dobro dziecka immamentnie związane z prawami człowieka. W opracowaniu zostaje ukazane, że w związku z brakiem transkrypcji człowiek jest traktowany przez władze publiczne jako obywatel „kategorii B”, a praktyczny aspekt posiadania polskiego aktu urodzenia jest niezwykle ważny w życiu codziennym. Artykuł wykazuje, że światopoglądowe kwestie powinny zostać odrzucone w imię dobra dziecka, zwłaszcza jako obywatela państwa. Główna oś opracowania opiera się na ukazaniu argumentów przeciwników i zwolenników ww. transkrypcji, ze szczególnym ujęciem konstytucyjnoprawnego pojęcia rodziny. Przeprowadzona analiza orzecznictwa ukazuje odmienne podejście do dopuszczalności dokonania transkrypcji aktu urodzenia dziecka pary nieheteronormatywnej. Artykuł ukazuje również relewantną pozycję Rzecznika Praw Obywatelskich w czuwaniu nad przestrzeganiem podstawowych praw człowieka. [The aim of the article is to present a broad understanding of the problem of transcription of the birth certificate of a same-sex couple’s child. Reflecting on this topic, it should be emphasized that the most important thing for a debate on this issue is the best interests of the child, closely related to human rights. The article shows that the best interests of the child should take precedence over ideological issues. The study shows that due to the lack of transcription, the child is treated by public authorities as a “category B” citizen, and the practical aspect of having a Polish birth certificate is extremely important in everyday life. The main axis of the study is based on the arguments of opponents and supporters of the above-mentioned transcription, with a particular understanding of the constitutional and legal notion of family. The conducted analysis of the jurisprudence shows a different approach to the admissibility of transcribing the birth certificate of a child of a non-heteronormative couple. The article also shows the proper position of the Ombudsman in overseeing the observance of basic human rights.]
