Summary/Abstract: This paper highlights and analyzes certain issues of legislative inconsistency regarding the prescription of criminal liability that impede the understanding and uniform application of legislation. To emphasize the importance of the topics discussed, examples are provided from judicial practice that illustrates the consequences of legislative gaps. In order to solve the identified questions, the opinions of researchers from the country and abroad who investigated the institution concerned are examined. Following this study, the appropriate conclusions are formulated to be taken into account in the teaching process of matters of criminal law and criminal procedure, and, last but not least, to improve the legislation of the Republic of Moldova.
