Putting of counterfeit values into circulation or acquisition of counterfeit payment instruments

Summary/Abstract: This paper is an analysis of the crime of putting counterfeit securities into circulation or acquiring counterfeit cashless payment instruments. We considered some introductory aspects in which we defined the crime and conducted a comparative examination with the previous incriminating text. We also analysed the pre-existing conditions and the constitutive content considering the current text, as amended and supplemented by Law no. 207/2021. The recent change captures the evolution of crime and in particular the prevention and combating of counterfeiting of cashless payment instruments. We would also insist on the consistency of the Romanian legislator for the incrimination of such deeds, proceeding to examine the provisions provided in the previous penal codes (the Criminal Code of 1864 and the Criminal Code Carol II). The in-depth analysis and the topicality of the incrimination recommend the usefulness of the presence in the university environment and that of the judicial practice.
